Legislated Rights
Legislated Rights are those rights which are protected by law. For example, the following are legislated rights relating to the area of sexuality and human relationships:
The right to sexual relationships if both partners are of legal age providing that:
- the person has given free and informed consent (that is, they understand what they are consenting to),
- the other person does not intend to take advantage of or sexually exploit the person with a disability and knows the person has a disability,
- the right to marry if the nature and effect of the marriage ceremony is understood and the couple are aged 18 years or over or, if younger, their parents or a court has consented,
- the right to live in a de-facto relationship if the person is over the legal age of consent, as previously outlined in the age of consent for sexual relationships,
- The right to have protection against unwanted sexual advances.
