Further to the Victorian Civil and Administrative Tribunal order of 29 April 2003, we furnish particulars of Ground 1 of our Statement of Grounds.
The proposal is not consistent with, amongst other things, the following clauses in the Port Phillip Planning Scheme:
21.03-6, 21.04-6, 21.05-1, 21.05-2, 21.05-3, 21.05-4, 21.05-5, 21.05-6, 21.05-7, 21.05-11, 22.01, 22.04, 22.06, 43.01, 43.02.
The proposal is not consistent with Schedule 12 to the Design and Development Overlay in the following respects:
1.0 Design objectives. The proposal appears to satisfy only points 4, 6, and
10 of the 18 design objectives;
2.0 Buildings and works. The proposal does not satisfy the majority of the design
objectives and other provisions of the schedule, and must be deemed non-compliant
with Clause 2.0 of Schedule 12.
